These Brand Terms govern advertiser ("Brand") use of Plaiyd to fund and run campaigns. They apply in addition to Plaiyd's general Terms of Service and Privacy Policy. By creating a brand account, funding a budget, or publishing a campaign, Brand agrees to these terms.
Plaiyd may reject, pause, edit, or remove any campaign at its sole discretion — including for quality, brand-safety, legal, or fraud reasons — before, during, or after launch. Approval of a campaign is not an endorsement and does not waive Plaiyd's right to pause it later. Brand grants Plaiyd a limited license to display Brand's names, logos, and campaign creative solely to operate and promote the campaign on the platform.
Campaign budgets are prepaid via Plaiyd's payment processor. Brand is charged only for completions that pass Plaiyd's verification systems, plus the marketplace fee disclosed on the Plaiyd for Brands page at the time of funding. Impressions, clicks, and completions flagged as fraudulent are not billed. Plaiyd may adjust the marketplace fee or minimum budget on a prospective basis; changes do not apply to already-funded budgets.
Unspent, uncommitted budget is refundable on request within a reasonable period after the campaign ends or is cancelled, less any completed spend, marketplace fees, and non-refundable payment-processor fees. Refunds are issued to the original payment method. Amounts already paid out to users for verified completions are non-refundable.
Campaigns may not promote: unlawful goods or services; adult, gambling, or firearms content targeted at minors; deceptive, misleading, or fraudulent claims; malware, phishing, or credential-harvesting; content that infringes third-party intellectual property; hate speech, harassment, or content that incites violence; medical, financial, or legal claims Brand is not authorized to make. Plaiyd may add categories to this list at any time.
Brand may use campaign data solely to measure and optimize its own campaigns on Plaiyd. Brand may not attempt to re-identify Plaiyd users, resell user data, or combine campaign data with external identifiers. Brand is responsible for its own compliance with applicable advertising, consumer-protection, and privacy laws (including CAN-SPAM, TCPA, GDPR, and CCPA where relevant).
Plaiyd provides the platform "as is" and does not warrant any specific business outcome, completion volume, conversion rate, or return on ad spend. To the maximum extent permitted by law, Plaiyd's aggregate liability to Brand for any claim arising out of or relating to Brand's use of the platform is limited to the amounts Brand paid to Plaiyd in the 90 days preceding the claim. Plaiyd is not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, revenue, or data.
Either party may terminate the brand relationship at any time. Plaiyd may suspend or terminate a brand account that violates these terms or engages in fraudulent, abusive, or unlawful activity. Sections 3–7 survive termination.
